At EYTE, we aim to make buying and selling art from the world’s greatest emerging talents as seamless as possible. These Terms and Conditions outline the roles and responsibilities of everyone involved – the buyers, sellers (artists), and us – from the moment an artwork is listed to its delivery to your doorstep.
What We Do
EYTE is an online gallery connecting buyers and sellers. While we facilitate the transaction, the purchase contract is directly between the buyer and the artist. We act as an agent and aren’t part of the sale agreement.
Placing an Order
When you order, you’re making an offer to buy directly from the artist. Details about the artwork, like size, material, and type, are listed on the site, but artists are responsible for the accuracy of the descriptions.
Payment and Ownership
Payment is made securely via EYTE, and ownership of the artwork transfers to the buyer only after full payment. If payment isn’t completed, the sale is canceled.
Delivery
Artists handle shipping and packaging, and delivery costs depend on the artwork’s size, weight, and destination. Artworks are usually delivered within 14 business days, though this may vary. Buyers should inspect the artwork immediately upon receipt and report any damage within 48 hours. Note that delivery costs and any applicable customs duties are the buyer’s responsibility.
Returns and Refunds
You can return an artwork if it’s damaged during delivery or if you change your mind (within 14 days of receiving it). For damaged items, send us photos and we’ll help coordinate the return. For returns due to a change of mind, you’ll cover the return shipping costs. Refunds are processed after the seller receives the returned artwork in its original condition.
Proper Care
Artworks require careful handling to preserve their condition. Avoid direct sunlight, humidity, or improper storage, as we don’t provide warranties for damage caused by improper care.
Copyright and Usage Rights
Purchasing an artwork gives you ownership of the physical piece, but the copyright remains with the artist. You can resell the artwork, but reproductions or other uses require the artist’s consent.
Data Protection
Your personal data is collected only as needed to process your order or support our artists. We prioritize your privacy and will not share your information with third parties without your consent.
Legal Framework
Swedish law applies to these Terms, but mandatory EU laws for international trade and digital sales also come into play when relevant.

Purpose
The website's purpose is to showcase artworks created by artists (“sellers”) and present them to users of the site (“buyers”), offering them the opportunity to explore and purchase these works directly from the sellers. EYTE operates as a digital art gallery and functions as an independent entity aiming to support emerging artists. Within the scope of its platform, EYTE serves as an agent, facilitating connections between sellers and buyers. Consequently, EYTE is not a party to any contract; contracts are established solely between buyers and sellers, with the seller being the only party bound by the obligations of the agreement.

About the Terms
These terms (alongside the privacy policy, cookie policy, and related documents) constitute the terms and conditions (“Terms”) governing your use of the website. It is essential that you carefully review these Terms before placing an order with EYTE. They provide information about the gallery and the artists, how to order products, how orders may be changed or canceled, how issues are handled, and other key details.
By accessing this website, you agree to these Terms and confirm your compliance with them. If you do not agree, you must not use the website. We recommend saving or printing a copy of these Terms for future reference. EYTE reserves the right to amend these Terms periodically. Please ensure you review the Terms before each use of the website to stay informed of any updates. The unconditional acceptance of these Terms is required from both sellers and buyers to complete a sale. Acceptance is confirmed by checking a box in the artwork order form.
Your Order
EYTE acts as an agent representing artists. When you place an order, you are offering to purchase an artwork from the artist under these terms, the specific terms of the artist, and the details on the artwork’s page. This creates a binding agreement between you and the artist. Each order you place and that is accepted by the gallery represents a separate contract with the artist.
Artworks listed include an explanation of the substrate, dimensions, and type. If an artwork becomes unavailable, the buyer will be notified via email within 48 hours, and the order will be canceled. EYTE is not responsible for listings, descriptions, or images of artworks on the site; this is the sole responsibility of the artist.
Note: Variations in color between the website’s product images and the actual artwork are possible and generally not considered defects. Natural wear, improper use, or poor care of artworks are also not covered under warranty law.
Price & Payment
The sale price of each artwork is displayed on the website and includes applicable taxes but excludes delivery and packaging fees, if any. Delivery methods and costs may or may not be outlined in the order summary depending on factors like artwork type, dimensions, weight, and delivery destination. In some instances we will contact you upon a sale to finalize the shipping costs and details in direct contact with you.
Payment for artworks is made via EYTE’s payment services, which include credit card and bank transfer options. Ownership of the artwork transfers to the buyer once full payment has been received. Failure to pay cancels the sale, and the artwork will be relisted.
Delivery
Artworks are delivered to the address provided in the order summary or the appropriate delivery office, during business hours, via the selected carrier.
Individual artists handle the dispatch and packaging of orders, ensuring proper protection and insurance for the artwork. Delivery methods, timelines, and costs vary depending on the artist’s location and chosen carrier.
Most deliveries are completed within 14 working days. While artists aim to dispatch orders within seven working days, delivery times depend on factors like the artist's availability and geographic distance. EYTE will keep buyers updated throughout the process. Delivery responsibilities, including timeliness, packaging quality, and artwork conformity, rest solely with the seller. EYTE is not liable for delays, damage, or loss caused by the delivery provider. Buyers may submit claims directly to the carrier but it is required that the buyer inspects the artwork and reports any issues in writing with photographs within 48 hours.
Delivery costs are paid by the buyer and vary based on the artwork's size, weight, and destination. Additional customs, excise duties, or VAT may apply depending on the destination and is paid on delivery via the courier.
Returns, Refunds, and Right of Withdrawal
You are entitled to return most artworks purchased through EYTE and request a refund. A refund will be issued to the original purchaser via the original payment method within 14 days of the seller receiving the returned artwork. For damaged or altered returns, the refund amount will be reduced by the artist’s material costs. Variations in color between website images and the physical artwork do not constitute a defect. Defects caused by natural wear, improper handling, or poor storage (e.g., exposure to direct sunlight or high humidity) are not covered by any warranty. Returns and refunds are not available under any other circumstances than those stated below:
I. Damaged Artwork at Delivery
If the artwork is damaged upon delivery, you must notify EYTE within 48 hours and return the item within ten days of receiving your order.
The buyer is required to take high-resolution photographs of the package both before and after opening, clearly showing the damage. These images, along with a detailed complaint, should be sent to hello@EYTE.se.
EYTE will handle the complaint with the delivery company and maintain close communication with the buyer, guiding them through the process, including the return of the damaged artwork to the seller.
The refund will be processed within 14 days of the seller receiving the returned artwork. Refunds are issued only to the original purchaser and will be credited back to the original payment method.
II. Change of Mind - Right of Withdrawal
You have the right to withdraw from the purchase within 14 days of receiving the artwork.
Notify EYTE of your decision via email at hello@EYTE.se, including: Your name, address, and contact details (phone and email), order reference, a clear reason for returning the artwork, high-resolution images of the artwork to verify its condition. Once EYTE is informed, the buyer must ship the artwork back to the agreed destination within seven days. The buyer is responsible for the return shipping costs. The return must use the same level of shipping service (including insurance) as was used for the original delivery to ensure proper protection of the artwork.
If the returned artwork arrives damaged, dirty, or altered (e.g., with fingerprints or scratches), it will be considered destroyed. In such cases, the buyer must compensate the artist for material expenses.
Proper Treatment of Artworks
Artworks may change in appearance due to environmental factors over time. EYTE does not guarantee against such changes.
Artworks should not be exposed to direct sunlight, heat, or humidity beyond normal living conditions. Special care should be taken with laminated or framed works to avoid scratches or stains.
No Rights Granted
Purchasing an artwork grants ownership of the physical piece but not reproduction or intellectual property rights. Buyers may resell the artwork but not reproduce or copy it.
Artists retain copyright and moral rights. EYTE holds a perpetual license to use images and information about the artworks for marketing purposes on the Website and in any marketing materials, including on any websites, social media, in any advertising campaigns, online or offline, at any time.
Data Protection
EYTE collects and processes buyer and seller data to execute its services and contracts. Users can access, modify, or delete their data by contacting hello@EYTE.se.
EYTE takes measures to protect personal information and retains data only as long as necessary.
Governing Law
These Terms are governed by Swedish law, subject to mandatory EU provisions where applicable.
